Smoking is NOT allowed within 30 feet of any building at Evergreen Valley including Condo units. There is NO SMOKING allowed inside the main building or our condo units. This includes ALL common areas and ALL units. This also includes Timeshare Owners during their owned week and Owner Rentals.
Smoking anywhere in the building or in particular units will result in a $150.00 cleaning/deodorizing charge.
Evergreen does allow dogs, with a fee of $25.00 per day per dog. Emotional support dogs are charged the same fee. Service dogs’ fees do not apply.
All guests and owners must sign a dog contract stating that if there is any damage, you, as a guest, are responsible. All dogs must be leashed at all times inside the inn and are restricted from certain common areas. All dogs must be up-to-date with all shots, especially rabies.
Individuals with disabilities must be allowed to be accompanied by their service animals in all areas of a place of PA where members of the public, clients, customers, patrons, invitees, or others are able to go. A PA may not designate certain areas of its facility as off-limits to individuals because they are with a service animal. For example, a restaurant cannot require a patron with a service animal to sit outside or in any particular restaurant section. A PA may not request or require a person to pay a fee or comply with special rules in order to be accompanied by their service animal, even if the PA requires that people be accompanied by pets. Service animals are not pets.
If a PA normally charges individuals for the damage they cause, an individual with a disability may be charged for damage caused by his or her service animal. What if there’s a problem with the service animal? Can it be removed? A PA may ask a person with a disability to remove a service animal from the premises if either (1) the animal is out of control and its handler does not take effective action to control it or (2) the animal is not housebroken. A service animal generally must be on a halter, tether, or leash, unless the handler’s disability prevents using a halter, tether, or leash, or doing so would interfere with the work or task the animal is trained to do. If the animal cannot be on a halter, tether, or leash, it must be otherwise under the handler’s control (such as through voice commands or hand signals). If a service animal is properly excluded, the PA must offer the person with a disability the opportunity to get or use its goods, services, or other benefits without the presence of the service animal. A service animal may also be removed from the premises if either (a) it is a direct threat to the health or safety of others, (2) it would result in substantial physical damage to the property of others, or (3) it substantially interferes with the reasonable enjoyment of the PA by others. This must be based on the particular animal’s behavior and not breed-based fears or assumptions.
Evergreen Valley staff and owners love to welcome your four-legged friends. They are very special to us. Your friend will also love Evergreen as we have many places for them to walk and enjoy nature.
However, lately a lot of guests are claiming that ESD are Service dogs and this is incorrect. We charge for Emotional Support Dogs as they are not Service dogs. Guests will argue with the front desk staff and this is our policy and it will not be changing. It is a privilege to bring your pet to your resort with you and your family. Most resorts are not pet friendly. Please honor our policy. Thank You
‘Are ESAs allowed in hotels? ‘
Generally, NO. Although both hotels and motels aim to offer a comfortable environment for rest and sleep, they are no part of the FHA’s “dwelling” category. The reason for this is that they are used for temporary lodging rather than housing for a long time. Unlike service dogs, emotional support animals fulfill the purpose of comfort and joy, but are not trained to perform physical tasks for the disabled owner. What’s more, some hotels take the safety and health of other customers into account, so poorly trained emotional support animals may be excluded from the list of “guests”.
